Terms of Use for Axon AI

1. Agreement to Terms

These Terms of Use ("Terms") constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”) and Axon AI ("we," "us," or "our"), concerning your access to and use of the Axon AI mobile application (the "App"). By accessing or using our App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

2. Privacy Policy

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and share your personal information. By using the App, you agree to the collection and use of information in accordance with our Privacy Policy, which is incorporated by reference into these Terms. 3. Who May Use the Services

You must be at least 13 years old to use the App. By using the App, you represent and warrant that you meet this age requirement and that you will comply with all applicable laws and regulations.

4. Content and Content Rights

For purposes of these Terms, "Content" means text, graphics, images, software, audio, video, works of authorship of any kind, and information or other materials that are posted, generated, provided, or otherwise made available through the App.

a. User Content

You are responsible for the content you provide to the App, including text prompts and uploaded images ("User Content"). You retain all ownership rights to your User Content. By providing User Content to the App, you grant us a worldwide, non-exclusive, royalty-free license to use, copy, reproduce, process, adapt, modify, publish, transmit, display, and distribute such User Content solely for the purpose of operating, developing, providing, and improving the App and our other services.

b. Generated Content

The content generated by the AI models based on your User Content ("Generated Content") is owned by you. You are free to use the Generated Content for any purpose, including commercial purposes, provided your use does not violate these Terms or any applicable laws. Please be aware that the use of Generated Content may be subject to the terms of the underlying AI models, and we do not claim any rights over the output of these third-party services.

5. In-App Purchases and Subscriptions

The App includes optional in-app purchases, including consumable "Coins" and auto-renewing "Premium" subscriptions.

• Payment: All payments will be processed through the App Store, from which you originally downloaded the application. Payment will be charged to your iTunes Account at confirmation of purchase.
• Subscriptions Auto-Renewal: Subscriptions will automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period.
• Managing Subscriptions: You may manage your subscriptions and turn off auto-renewal by going to your Apple ID Account Settings after purchase.
• Refunds: All purchases are final and non-refundable, except as required by applicable law.

6. General Prohibitions and Acceptable Use

You agree not to do any of the following:

• Use the App for any illegal or unauthorized purpose.
• Generate or disseminate content that is hateful, abusive, harassing, threatening, or otherwise objectionable.
• Generate or disseminate content that infringes upon or violates the intellectual property rights of others, including copyrights and trademarks.
• Generate sexually explicit material, nudity, or other content that may be deemed Not Safe For Work (NSFW).
• Attempt to reverse engineer, decompile, or otherwise discover the source code of the App.
• Use the App in any way that could interfere with, disrupt, or negatively affect other users from fully enjoying the App.

7. Termination

We may terminate or suspend your access to the App, at our sole discretion, at any time and without notice to you, for any reason, including if you violate these Terms.

8. Disclaimers

THE APP AND SERVICES ARE PROVIDED "AS IS," WITHOUT WARRANTY OF ANY KIND. WE MAKE NO WARRANTY THAT THE SERVICES WILL MEET YOUR REQUIREMENTS OR BE AVAILABLE ON AN UNINTERRUPTED, SECURE, OR ERROR-FREE BASIS. THE CONTENT GENERATED BY AI MODELS MAY BE UNPREDICTABLE, AND WE MAKE NO WARRANTY REGARDING THE QUALITY, ACCURACY, OR RELIABILITY OF ANY GENERATED CONTENT.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, LOSS OF DATA OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR THE USE OF THE APP.

10. Governing Law

These Terms shall be governed by the laws of Turkey, without regard to its conflict of laws provisions.
